Updated Form I-9 for New Hires Plus a New Alternative Verification Method

The new version of Form I-9 is out and available for use as of August 1, 2023. It can be found at Employment Eligibility Verification | USCIS.  There is no need for employers to have current employees complete an updated version unless re-verification is required after October 31, 2023.

Changes on the new I-9 include standalone documents for preparer or translator certification and re-verification or rehire. The form can be filled out on tablets, mobile phones, or downloaded.

The biggest change is the new option to use an alternative verification method that allows employers to verify documents remotely. Employers cannot require employees to use the alternative procedure and cannot discriminate on when to use it based on citizenship, immigration status, or national origin. Qualified employers eligible to use the alternative procedure need to be in good standing with federal E-Verify, that process can be started through The Enrollment Process (e-verify.gov).

Keep in mind that to use the alternative method employers will need to receive documents remotely from prospective employees and conduct a live video meeting to review the same documents for verification purposes. Any documents sent for verification should be clear and legible and retained by the employer. Don’t forget to check the box “alternative procedure” on the Form I-9
